Controlled substances are categorized into Schedules, with Schedule I substances considered the most dangerous, with a high likelihood of abuse and no accepted medical use. Schedule V substances are considered those with the lowest potential for abuse with an accepted medical use.

  • Manufacturing, delivering, or possessing with the intent to deliver a Schedule I or II narcotic substance is a felony. It can result in up to 15 years of imprisonment and/or a fine of up to $250,000.
  • Manufacturing, delivering, or possessing with intent to deliver methamphetamine, phencyclidine, cocoa leaves, derivatives of any of these substances, or over 1,000 pounds of marijuana is a felony. It results in imprisonment for up to 10 years and/or fines up to $100,000.
  • Manufacturing, delivering, or possessing to deliver any other substance or counterfeit substance categorized in Schedule I, II, or III is a felony. Penalties include up to five years of imprisonment and/or up to $15,000 in fines.
  • Manufacturing, delivering, or possessing with the intent of delivering a Schedule IV substance is a felony. Penalties include up to three years of imprisonment, and/or fines up to $10,000.
  • Manufacturing, delivering, or possessing with the intent to deliver a Schedule V substance is a misdemeanor. It can result in imprisonment up to one year, and/or a fine of up to $5,000.
  • Possession of a controlled substance is a misdemeanor. It can lead to up to one year of imprisonment and/or fines up to $5,000. When fraud, forgery, knowing illegal purchase, or other specifics are included in the offense, the penalties can increase to up to three years of imprisonment and/or up to $5,000 in fines.
  • Second offense possession of a controlled substance can result in up to three years of imprisonment and/or a fine of up to $25,000.
  • Possession, possession with intent to distribute, or distribution of 30 grams or less of marijuana is a misdemeanor. Penalties can include up to 30 days of imprisonment and/or a fine of up to $500.

Fines can be higher in some offenses, like those involving narcotics and methamphetamine, to equal the value of the resources used to commit the offense and the profits gained from the offense.
